Terms of the Actual Rental Contract: (Copy will be mailed/faxed/emailed to you):

 1. The Landlord has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the above mentioned expiration time and date of their rental period.

 

 2.  The Landlord has the right to make any and all repairs and improvements to property during your stay and will make every effort to provide prior notice to the Tenant.

 

3.  The Landlord has the right to either remove or place their personal items in the owner's garage located on the property during Tenants' stay and will make every effort to provide prior notice to the Tenant.

 

4.  All guests are required to 'drive in' to the circular driveway and 'drive out' of the circular driveway.  No backing out is permitted as either side of the drive is flanked with a culvert lined with rock to ensure rainwater from the top of the mountain to exit at the bottom.  The Landlord will not be held responsible for any damages incurred to the Tenants vehicle if they drive/back out over the edge into the culvert.

 

5.  There is a long distance block on the telephone - a calling card is needed for long distance toll calls. Emergency medical and police services can be called by dialing 911.

 

6.  The Tenants shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The tenants shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants. Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the Landlord shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings.  If repair costs are greater than security deposit, Landlord will proceed with a lawsuit to cover repair costs.

 

7.  The Tenants shall dispose of all waste material generated during the rental period in a lawful manner. Trash is to be wrapped and secured tightly in garbage bags (initial supply is provided – no un-bagged trash permitted) and then placed in the large plastic Rubbermaid storage unit that is located outside of the garage on a daily basis during their stay.  The caretaker/cleaning personnel will dispose of the trash at the local dump at the end of your stay.   No trash is to be left outside overnight by the Tenant due to it attracting animals onto the property, and will result in an additional cleaning fee.

 

8.  The Tenants shall pay for any damage done to the premises over and above normal wear and tear.

 

9.  No animals or pets of any kind will be brought onto the premises.  If unauthorized pets are detected on premises, a $150 cleaning fee will be charged and immediate eviction will result.

 

10.  The Tenants shall not sublet the property during their stay.

 

11.  The Tenants shall have no more than 6 (six) persons reside or sleep on the premises, noting that each individual over 4 will be charged an additional $15.00 per night.

 

12.  The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants will be immediately evicted.

  

13.  There shall be NO SMOKING inside the premises. Smoking is permitted outside the home as long as Tenants do not litter on the surrounding grounds and all flammable materials are extinguished and disposed of safely.  The bungalow is located in a highly wooded environment and the area is in a state of drought, so please be extremely cautious to prevent a fire!

 

14.  Landlord shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Landlord’s family. Toilet paper, soap, dish detergent, laundry soap, shampoos, and other consumables are to be purchased by the Tenant. No reimbursement will be made for unused consumables left at the premises.   

 

15.  The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.

 

16.  Rental Deposit amount is fully refundable up to 4 (four) weeks prior to the beginning of the rental period with written notice. If less than four weeks prior to the rental period, the Landlord shall have the right to retain the initial Rental Deposit at the Landlord' discretion as noted in Cancellation section found below. 


17.  Tenants agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlord enforcing this agreement.

 

18.  Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that the Tenants do not intend to make the property a residence or household.

 

19.  Landlord will not provide a refund due to power/water/cable/propane outages.

 

20. There shall be no refunds of rent due to shortened stays or ruined expectations due to weather conditions.

 

21. Landlord shall not issue any refunds of rent to the Tenant because of shortened stays or ruined expectations due to Tenants work, family emergencies or other commitments.

 

22.  If the property should go on the MARKET FOR SALE during your rental period, it may be shown to qualified buyers during the Tenants’ stay.  Every effort will be made to schedule the showing at a convenient time and not interrupt the Tenant’s stay. Tenant shall allow reasonable viewings of the home between the hours of 10 am and present or not.

 

23.  Tenant agrees that no Firearms are allowed on the premises during rental period.

 

24.  Tenant agrees that Fireworks and other hazardous materials shall not be used in or around the property during their rental period.

 

25.  Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc., shall cause termination of this agreement, immediate eviction with no refund of rents or deposits.

 

26.  Tenant agrees not to access the owner’s garage, even if mistakenly left unlocked, which contains cleaning supplies and chemicals that could be hazardous to children and adults. This garage is located on said property and is off limits to any and all renters.

 

27.  Tenant is advised that the bungalow contains a gas stove and cook top, gas heating, gas grill, and other gas powered items and will seek help from management if the proper operation of such items is not fully understood.

 

28.  The property has a fire extinguisher located on the counter in the kitchen area. The fire extinguisher was fully charged at last inspection. It is the duty of the Tenant to inform management immediately should the fire extinguisher become less than fully charged. Tenant agrees to use the fire extinguisher only for true emergencies and contact 911 immediately in case of fire.

 

29.  The property has fire alarms installed and they are believed to function properly at the time of rental. Tenant will notify management without delay if a fire alarm “chirps” to indicate a low battery condition.

 

30.  Tenant is advised that there is no carbon monoxide detector on the property and accepts the risk involved in not having one on said premises.

 

31.  Tenant shall see to their own security while in the property by locking doors and windows, etc. when it’s prudent to do so.  When leaving the cabin for any period of time, Tenant agrees to lock all doors and gates to prevent theft.

 

32.  Valuable items left behind by Tenant will be held for the Tenant and every reasonable effort will be made to contact the Tenant for return. If items are not claimed for longer than 6 months they shall become the property of the Landlord. The Landlord shall not be help liable for condition of said items.

 

33.  Cable TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of contents, or personal preferences by the Tenant with regard to cable TV service.

 

34.  There is no internet service at the cabin and is not integral to the agreement.   There is an internet café and local library in Murphy that provide wireless service if so desired by the Tenant, at the Tenant's expense.

 

35.  Tenant agrees that air conditioning shall not be set below 75 degrees and heat shall not be set above 78, and that the fan setting shall be left at “Auto” at all times. Doors and windows shall be closed when either heat or air conditioning is in operation during your stay.

 

36.  Only the Tenant making the reservation will be provide the key pad code and directions to the bungalow.  Lost key will require the entire bungalow to be re-keyed by a professional locksmith and costs incurred will be charged to the renter.

 

37.  Returned checks will incur a $50.00 service charge.

 

38.  All used linens and sheets are to be placed in the bathtub in the guest bath upon departure.

 

39.  All personal food items are to be removed and discarded from the refrigerator upon departure.

 

40.  If the gas grill is used, it and the grill utensils must be left clean, the propane bottle for the grill is turned off and the cover is on.

 

41.  ATV's or dirt bikes are not allowed in the community that the bungalow resides in.  There are numerous trails in the area that allow this sport.  Please see selection of brochures in the bungalow or visit the area Chamber of Commerce for more details.

 

 Minimum Age Requirement:

You must be of legal and responsible age to rent out Boden's Bungalow.  We will not rent to anyone under the age of 25 years old.  This person must be one of the guests who remains with the rental party throughout their stay.  A copy of the Tenants driver's license will be required with the security deposit to rent the bungalow.

 

                                                         Cancellation Policy:

               All cancellations must be received, in writing, to our address 30 days prior to check in

                                                   date to receive 100% of all fees.

 

                                             If after 30 days prior, the following applies:

                                      29 – 15 days prior: 50% refund of weekly rental fee

                                       7 – 14 days prior: 25% refund of weekly rental fee

                                                   6 – 0 days prior: NO REFUND

                                                        NO SHOW = NO REFUND

 

                                                                Eviction Policy: 

 Staying at Boden's Bungalow is a privilege, not a right.  We do not tolerate wild and loud guests, or any guests who cause disturbances to our neighbors.  Boden's Bungalow is located in a private, deed restricted community.  We retain the right to evict any guest that is disturbing the neighborhood or harming the property.  We expect you and the people in your group to abide by the rental rules listed in the contract that you signed.  If we or any local authorities receive complaints about you from the neighbors, you will be removed from the property and no refund will be given.
